This article describes the labeling requirements for retail establishments.

NOTE: For licensees that operate retail establishments that sell to consumers, all packages must have labels that include the following:

  • License Number of the Cultivation Facility

  • License Number of the Retail Store that Sold the Marijuana

  • The Identity Statement and Standardized Graphic Symbol of the Retail Marijuana Store that sold the Retail Marijuana to the consumer

  • Harvest Batch Number of the Product Inside the Container

  • Date of Sale to the Customer

  • Net Weight
    -- In grams to 1/10 of a gram of the product, prior to placing it in the container

  • Universal Symbol

Must be on the front of the packaging and no smaller than 1/2 inch x 1/2 inch) with a statement below it:

  • “Contains Marijuana. Keep out of the reach of children.”

  • Warning statements:

“There may be health risks associated with the consumption of this product.”

“This product contains marijuana and its potency was tested with an allowable plus or minus 15% variance pursuant to 12-43.4- 202(3)(a)(IV)(E), C.R.S.”

“There may be additional health risks associated with the consumption of this product for women who are pregnant, breastfeeding, or planning on becoming pregnant.”

“Do not drive or operate heavy machinery while using marijuana.”

  • Required Potency Statement:

Percentage of total THC and CBD from the test results for that Harvest Batch

If the Harvest Batch is not required to be tested, either of the following 2 options will be utilized for the potency statement:

  1. A range of percentages of total THC and CBD that extends from the lowest percentage to the highest percentage for each cannabinoid listed, from every test conducted on that strain of Regulated Marijuana cultivated by the same Marijuana Cultivation Facility during the preceding six months

    OR

  2. An average for each cannabinoid listed, from every test conducted on that strain of Regulated Marijuana cultivated by the Marijuana Cultivation Facility during the preceding six months. If CBD is not detected in Harvest Batch, then Total CBD potency is not required.

    The potency of Marijuana Concentrates’ Total THC and CBD shall be expressed as a percentage. If CBD is not detected in the Production Batch, then Total CBD potency is not required.

The potency of Regulated Marijuana and Marijuana Concentrate shall be displayed in:

  • Font that is bold and enclosed within an outlined shape such as a circle or square;
    OR

  • Highlighted with a bright color such as yellow.

  • Required Contaminant Testing Statement for Production Batch of Marijuana:

If no testing for residual solvents, mold, and mildew, then the package shall be labeled with the following statement:

  • "The marijuana contained within this package has not been tested for contaminants.”

If testing for contaminants did successfully test and validate their process, then the package shall be labeled with the following statement:

  • "The marijuana contained within this package complies with the mandatory contaminant testing required by rule R 1501."


General Labeling Requirements for Flower, Shake/Trim and Concentrate Sales to a Consumer

  • The License Number for the Cultivation Facility, Manufacturer and Store

  • Batch Harvest Number

  • Net Weight

  • Date of Sale to the Patient or Customer

  • Patient Number

  • Solvent List

  • Ingredients List Including Allergens

  • Universal Symbol:

Must be on the front of the packaging and no smaller than 1/2 inch x 1/2 inch) with a statement below it:

  • “Contains Marijuana. Keep out of the reach of children.”

  • Potency statement:

Percentage of total THC and CBD from the test results for that Harvest Batch

    OR

  • Highlighted with a bright color such as yellow.

  • Required warning statements:

“This product was produced without regulatory oversight for health, safety, or efficacy.”

“There may be long term physical or mental health risks from use of marijuana including additional risks for women who are or may become pregnant or are breastfeeding. Use of marijuana may impair your ability to drive a car or operate machinery.”

  • "Statement of Intended Use”

The Container and any Marketing Layer shall identify one or more intended use(s) for Marijuana Concentrate from the following exclusive list:

Inhaled Product:

  • Flower or Trim (including pre-rolled joint and Kief)

  • Solvent-Based Medical Marijuana Concentrate

  • Solvent-Based Retail Marijuana Concentrate

  • Water-Based Medical Marijuana Concentrate

  • Water-Based Retail Marijuana Concentrate

  • Heat/Pressure-Based Medical Marijuana Concentrate

  • Heat/Pressure-Based Retail Marijuana Concentrate

  • Vaporizer Delivery Device

  • Pressurized Metered Dose Inhaler

For Oral Consumption:

  • Food or Drink infused with Regulated Marijuana

  • Regulated Marijuana Concentrate intended to be consumed orally

  • Pills and Capsules

  • Tinctures

Skin and Body Products:

  • Topical

  • Transdermal

Audited Product:

  • Metered Dose Nasal Spray

  • Vaginal Administration

  • Rectal Administration

Transfer of Product to Store, Patient, or Consumer

  • The license number for the cultivation facility, manufacturer, and store

  • Batch harvest number

  • Net weight

  • Ingredients list including allergens

  • Solvent list

  • Date of sale to the patient or customer
